Welcome to Fresh Tha Band's website. These Terms of Service ("Terms") govern your use of our website located at freshthaband.com (the "Site") and the purchase of tickets, merchandise, and other products and services offered through the Site (collectively, the "Services").

By accessing or using our Site and Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or Services.

Eligibility

To use our Services and make purchases, you must:

• Provide accurate and complete information when making purchases

Ticket Purchases

General Terms

• All ticket sales are final and non-refundable except as outlined in our Refund Policy below
• Tickets are sold on a first-come, first-served basis
• Ticket prices are subject to change without notice
• Limit restrictions may apply to certain events

Ticket Delivery

Tickets will be delivered electronically to the email address provided at checkout. Digital tickets will include a QR code for entry and should be presented (printed or on mobile device) at the venue.

Ticket Transfer and Resale

• Tickets may be transferred to another person for personal use
• Commercial resale of tickets above face value is prohibited
• We reserve the right to cancel tickets that have been resold in violation of these Terms

Event Changes

Event dates, times, venues, and lineups are subject to change. In the event of a cancellation or significant change:

• Event Cancellation: Full refund will be issued to the original payment method
• Event Postponement: Tickets will be honored for the rescheduled date. Refunds may be requested within 14 days of postponement announcement
• Venue Change: Tickets will be honored at the new venue

Merchandise Purchases

Product Availability

All merchandise is subject to availability. We reserve the right to limit quantities and discontinue products at any time without notice.

Pricing

Prices are displayed in US Dollars and do not include shipping costs or applicable taxes, which will be calculated at checkout.

Shipping

• Shipping times are estimates and not guaranteed
• Risk of loss passes to you upon delivery to the carrier
• International orders may be subject to customs duties and taxes
• We are not responsible for delays due to carrier issues or customs

Digital Products

Digital products (such as music downloads) are delivered electronically and are non-refundable once downloaded.

Refund Policy

Event Tickets

• Event Cancellation: Full refund within 7-10 business days
• Event Postponement: Refund available upon request within 14 days of announcement
• Customer Request: No refunds for change of plans or inability to attend

Merchandise

• Damaged/Defective Items: Full refund or replacement within 30 days of delivery
• Wrong Item Received: Full refund or correct item shipped at no additional cost
• Change of Mind: Exchange or store credit within 14 days if item is unworn/unused with tags attached
• Final Sale Items: No refunds or exchanges on items marked as final sale

How to Request a Refund

To request a refund, please visit our Customer Support page or email us at info@freshthaband.com with your order number and reason for the refund request.

Payment Terms

We accept the following payment methods through our secure payment processor, Square:

• Credit Cards (Visa, Mastercard, American Express, Discover)
• Debit Cards
• Apple Pay and Google Pay

By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the full amount of your purchase.

All transactions are processed securely through Square. We do not store complete credit card information on our servers.

Promotional Codes & Discounts

• Promotional codes are valid only during their specified promotional period
• Codes cannot be combined with other offers unless explicitly stated
• One promotional code per order
• We reserve the right to modify or cancel promotions at any time
• Abuse of promotional codes may result in order cancellation

User Conduct

When using our Site and Services, you agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Use automated systems to access or interact with the Site
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Site
• Submit false or misleading information
• Engage in fraudulent transactions
• Resell tickets commercially above face value

Violation of these rules may result in termination of your access and cancellation of orders.

• Use our content for commercial purposes without authorization

The Fresh Tha Band name, logo, and "Funky Real Entertainers Standing Here" are trademarks of Fresh Tha Band.

Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Site will be uninterrupted or error-free
• Defects will be corrected
• The Site is free of viruses or harmful components

Limitation of Liability
